Terms of use – Opal Property Advisory

These Terms of Use (Terms) govern your use of the Opal Property Advisory website located at www.opalpropertyadvisory.com.au (Website). By accessing or using this Website, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Website.

These Terms operate alongside Opal’s Privacy Policy. Together, they form the entire agreement between you and Opal regarding your use of the Website.

2 General use of Website

2.1 Opal grants you a non-exclusive, revocable, non-transferable licence to use the Website solely for personal, non-commercial purposes, subject to these Terms.
2.2 Opal retains complete editorial control over the Website and may update, modify, suspend or discontinue any aspect of the Website at any time without notice.
2.3 The Website may not operate continuously and may be unavailable from time to time for maintenance or other reasons. To the maximum extent permitted by law, Opal is not liable for any Website outage or inaccessibility.
2.4 These Terms prevail to the extent of any inconsistency between these Terms and anything else on the Website.

3 Intellectual Property

3.1 All Intellectual Property in the Website and Content is owned by Opal or its licensors. Nothing in these Terms transfers any Intellectual Property rights to you.

3.4 You warrant that you have all rights necessary to grant Opal these licences.

4 User Conduct

4.1 You must not use the Website for any unlawful, harmful or improper purpose.
4.2 You must not submit content that is defamatory, offensive, discriminatory, infringing, misleading, obscene, or otherwise objectionable.

5 Advisory-board members and third-party providers

5.1 The Website may refer to or feature content supplied by third-party providers or Opal’s advisory-board members. Any such individuals provide insights or commentary in their own capacity or as representatives of their own separate entities.
5.2 Third-Party Providers are independent of Opal. Opal does not supervise, control or guarantee their services and is not responsible for any advice or service they provide.
5.3 Inclusion of a third-party provider on the Website does not constitute an endorsement, warranty or recommendation of that provider. Users must conduct their own due diligence before engaging any third party.

6 No professional advice

6.1 Opal is a licensed real estate agency and conducts business as a buyer’s agent. Opal is not:
• a financial services licensee;
• a mortgage broker or credit provider;
• a legal practitioner;

• a licensed builder, engineer or town planner.
